Terms of Service

These Terms of Service (“Terms”) govern your access to and use of AccessPPO.com (the “Site,” “AccessPPO,” “we,” “us,” or “our”) and the services we provide, including connecting you with independent, licensed insurance agents and agencies. By accessing or using the Site, or by calling a telephone number we advertise, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

1. What AccessPPO Is — and Is Not

AccessPPO.com is an advertising and referral service that connects consumers with independent, licensed insurance agents and agencies who can discuss insurance products and prepare quotes. We are not an insurance company, we are not a government agency or marketplace, and we are not affiliated with or endorsed by the United States Government, healthcare.gov, or any state or federal public insurance exchange. We do not sell insurance directly, we do not make coverage or eligibility decisions, and we do not provide insurance, legal, tax, financial, or medical advice. Invitations for applications for insurance are made through SPARKM LLC with Champion Benefits Group, and through other licensed and appointed agents and agencies, only where licensed and appointed.

2. Eligibility

You must be at least 18 years old and a resident of the United States to use the Site. By using the Site, you represent and warrant that you meet these requirements and that any information you provide is accurate and belongs to you.

3. Consent to Be Contacted

By submitting your information or calling us, you agree to the contact consent described in our Privacy Policy, including consent to be contacted by us and our partner agents, agencies, and carriers by telephone call, text message, artificial or prerecorded voice, and email — including through automated technology — at the contact information you provide, even if your number is on a Do-Not-Call list. Consent is not a condition of purchase. You may opt out at any time as described in our Privacy Policy and Do Not Call request form.

4. No Guarantees

Quotes, rates, plan availability, and eligibility are determined solely by the insurance carriers and licensed agents, not by AccessPPO, and are subject to underwriting, qualification, and the terms of each plan. Products are not available in all states and may include major medical plans, short-term plans, fixed indemnity plans, and other products. Comprehensive Affordable Care Act plans may be available only during the open enrollment period (typically November 1 through January 15) unless you qualify for a special enrollment period. Visit healthcare.gov for information about ACA requirements and coverage.

5. Informational Purposes Only

All content on the Site is provided for general informational purposes only and is not insurance, legal, financial, tax, or medical advice. You should speak with a licensed agent and review official plan documents before making any decision.

6. Third-Party Agents, Carriers, and Services

The agents, agencies, and carriers you may be connected with are independent third parties. AccessPPO does not control and is not responsible for their acts, omissions, advice, products, or privacy practices, or for any policy you may purchase. Your dealings with any third party are solely between you and that third party.

7. Intellectual Property

The Site and its content, including text, graphics, logos, and trademarks, are owned by AccessPPO or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use. You may not copy, reproduce, distribute, modify, or create derivative works from the Site without our prior written permission.

8. Acceptable Use

You agree not to misuse the Site, including by: providing false information or another person’s information without authorization; using the Site for any unlawful or fraudulent purpose; attempting to gain unauthorized access to the Site or its systems; interfering with the operation of the Site; or using automated means to scrape or harvest data.

9. Disclaimers

THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION ON THE SITE IS ACCURATE OR COMPLETE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AccessPPO AND ITS OPERATOR, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY INTERACTION WITH A THIRD-PARTY AGENT, AGENCY, OR CARRIER, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold harmless AccessPPO, its operator, affiliates, and service providers from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

12. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. The state and federal courts located in Washington will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Site.

13. Changes to These Terms

We may modify these Terms at any time. When we do, we will update the “Last updated” date above. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

14. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and AccessPPO regarding the Site.
